Welcome to On The Mat.

These Terms of Service (“Terms”) govern your use of the On The Mat website, our studio, classes, memberships, programs, workshops, events, digital services, and any other products or services offered by On The Mat.

In these Terms, “On The Mat,” “we,” “us,” and “our” refer to On The Mat, located in Vancouver, British Columbia, Canada.

By accessing our website, creating an account, making a purchase, booking or attending a class, or using our services, you agree to these Terms.

Certain memberships, programs, purchases, waivers, promotions, or services may also be subject to additional terms provided to you at the time of purchase or registration. If there is a conflict between these Terms and a mandatory requirement under applicable law, applicable law will govern.

  • Create or approve your account;

  • Purchase services on your behalf;

  • Complete required waivers; and

  • Provide any required consent.

We may establish minimum age requirements for particular classes, memberships, events, or services.

Momence may be used for:

  • Account creation

  • Bookings

When you create an account, make a booking, purchase services, or otherwise interact with On The Mat through Momence, you may also be subject to Momence’s applicable terms and privacy practices.

On The Mat is not responsible for outages, errors, security incidents, processing failures, or other issues caused solely by Momence or another independent third-party provider, except to the extent responsibility cannot lawfully be excluded.

If there is a discrepancy between information displayed through Momence and our internal records, please contact us so that we can investigate.

4. Account Registration

Certain services may require you to create an account through Momence or another platform designated by On The Mat.

You agree to provide accurate, current, and complete information.

You are responsible for:

  • Maintaining accurate account information;

  • Keeping your login credentials confidential;

  • Activities conducted through your account; and

  • Promptly notifying us if you suspect unauthorized access.

You may not impersonate another individual or knowingly provide false account information.

5. Bookings

Bookings are subject to availability.

A booking is not guaranteed until it has been successfully confirmed through Momence or another booking method approved by On The Mat.

You are responsible for reviewing your booking confirmation and ensuring that you have selected the correct:

  • Class;

  • Date;

  • Time;

  • Location;

  • Service; and

  • Participant.

We reserve the right to establish booking windows, capacity limits, waitlists, eligibility requirements, and other reasonable booking rules.

6. Class Schedule

Our class schedule may change from time to time.

We may:

  • Add or remove classes;

  • Change class times;

  • Change instructors;

  • Substitute instructors;

  • Change class formats;

  • Modify class capacity;

  • Change rooms or locations;

  • Cancel classes; or

  • Adjust programming.

An instructor substitution does not ordinarily entitle a customer to a refund.

If On The Mat cancels a class, any applicable class credit, refund, or booking restoration will be handled in accordance with the type of purchase and applicable law.

7. Arrival and Check-In

Clients should arrive with sufficient time to check in and prepare for class.

On The Mat may establish a late-entry policy for safety and to avoid disrupting other participants.

Depending on the class and circumstances, clients who arrive after the designated start time may not be permitted to participate.

If you are denied entry because you arrived late, the booking may be treated as a late cancellation or no-show in accordance with the policy applicable to your membership or booking.

Studio doors may be locked after class begins where reasonably necessary for security or safety.

8. Cancellation Policy

Cancellation requirements may vary depending on the class, appointment, membership, package, event, workshop, or service purchased.

The applicable cancellation window will be disclosed through Momence, at checkout, in your membership terms, or otherwise communicated by On The Mat.

Unless otherwise stated for a particular service, customers must cancel a class before the applicable cancellation deadline to avoid losing the class credit or being charged an applicable late-cancellation fee.

Cancellation must be completed using the method specified by On The Mat, which may include cancellation through your Momence account.

Sending an Instagram message, social media message, or informal message to an instructor does not necessarily constitute a valid cancellation.

Nothing in this section limits any cancellation rights that you may have under applicable British Columbia consumer-protection legislation.

9. Late Cancellations

Bookings cancelled after the applicable cancellation deadline may be considered late cancellations.

Depending on your membership or booking type, a late cancellation may result in:

  • Loss of the class credit;

  • Deduction of a class from your package;

  • A late-cancellation fee;

  • Loss of the booking without refund; or

  • Another consequence disclosed when you purchase the applicable service.

Any applicable fee will be disclosed through the relevant membership, package, pricing page, checkout process, or studio policy.

10. No-Shows

A “no-show” occurs when you have a confirmed reservation but do not attend and do not cancel within the permitted cancellation period.

No-shows may result in:

  • Loss of the class credit;

  • Deduction of a class from your package;

  • A no-show fee; or

  • Other restrictions disclosed through your membership or booking terms.

Repeated no-shows may result in temporary restrictions on advance booking if reasonably necessary to maintain fair access to limited class capacity.

11. Waitlists

Certain classes may offer a waitlist.

Joining a waitlist does not guarantee a place in the class.

If space becomes available, Momence may automatically add you to the class or notify you according to the system configuration in effect at that time.

By joining a waitlist, you acknowledge that you are responsible for monitoring your booking status.

Once you are moved from the waitlist into the class, the normal cancellation and no-show rules may apply.

Waitlist procedures may vary depending on how close the class is to its scheduled start time.

12. Drop-In Classes

Drop-in purchases are valid only for the class or period specified at purchase unless otherwise stated.

Unused drop-in purchases may be non-refundable except where a refund or cancellation right is required by applicable law.

13. Class Packs and Passes

Class packs may:

  • Have an expiration date;

  • Be limited to certain classes;

  • Be limited to one individual;

  • Be non-transferable;

  • Be subject to booking and cancellation rules; and

  • Be subject to additional conditions disclosed at purchase.

Any expiry period will be disclosed at the time of purchase.

Unless required by applicable law, expired credits may not be reinstated.

Class packs have no cash value and may not be redeemed for cash except where required by law.

14. Memberships

On The Mat may offer recurring or fixed-term memberships.

Membership benefits, pricing, billing schedules, class access, commitment periods, cancellation requirements, and other conditions will be disclosed at the time of purchase.

By purchasing a membership, you agree to the specific membership terms presented to you in addition to these Terms.

Where applicable law gives you rights beyond those contained in a membership agreement, those statutory rights will continue to apply.

15. Recurring Memberships and Automatic Billing

If you purchase a recurring membership, you authorize On The Mat and its payment processors to charge your selected payment method according to the billing schedule disclosed when you enroll.

Charges may continue until the membership is cancelled in accordance with the applicable membership terms or otherwise terminates.

You are responsible for maintaining a valid payment method.

Depending on the membership, billing may occur:

  • Weekly;

  • Bi-weekly;

  • Monthly; or

  • According to another schedule disclosed at enrollment.

Taxes may be added where required.

16. Failed Payments

If a recurring payment cannot be processed, we or our payment provider may attempt to process the payment again.

If payment remains outstanding, we may:

  • Suspend membership access;

  • Prevent additional bookings;

  • Cancel future bookings;

  • Request an updated payment method;

  • Suspend or terminate the membership; or

  • Recover outstanding amounts lawfully owing.

Reasonable administrative or failed-payment fees may apply only where they have been properly disclosed and are permitted by law.

17. Membership Cancellation

The cancellation process applicable to your membership will be explained when you purchase the membership.

Depending on the membership type, cancellation may require written notice or completion through Momence.

Any contractual cancellation policy is subject to the rights provided to consumers by applicable British Columbia law.

Where applicable, those rights may include rights to cancel certain fitness or continuing-services contracts:

  • Within a statutory cancellation period;

  • Following certain material changes in the customer’s circumstances;

  • Following certain material changes in the services supplied;

  • Where required contractual information was not provided; or

  • In other circumstances established by law.

Nothing in these Terms waives or restricts a right that cannot legally be waived or restricted.

18. Statutory Cancellation Rights in British Columbia

Certain memberships, passes, programs, or other services offered by On The Mat may constitute “continuing services contracts” or “future performance contracts” under British Columbia consumer-protection legislation.

Where those laws apply, you may have cancellation and refund rights beyond On The Mat’s standard studio cancellation policy.

Among other rights provided under applicable law, certain consumers may have the right to cancel an eligible fitness contract within 10 days after receiving a copy of the contract.

Additional rights may apply in circumstances such as certain material changes affecting your ability to participate or material changes to the services supplied by the studio.

On The Mat will comply with mandatory cancellation, disclosure, contract-content, refund, and related requirements imposed by applicable law.

For clarity, a class cancellation policy or membership cancellation policy does not override statutory consumer rights.

19. Membership Holds and Freezes

Certain memberships may permit temporary holds or freezes.

Eligibility, maximum hold duration, minimum notice, applicable charges, frequency limits, and acceptable reasons may vary by membership.

A membership hold is not effective until confirmed by On The Mat.

Medical, pregnancy, relocation, or other circumstances may also give rise to separate rights under applicable law.

20. Introductory Offers and Promotions

Introductory memberships, trials, first-class offers, promotional packages, and similar promotions may be subject to additional conditions.

Unless otherwise stated:

  • Introductory offers are available to new clients only;

  • Offers are limited to one per person;

  • Offers may not be combined;

  • Offers have no cash value;

  • Offers may not be transferred;

  • Promotional pricing may expire; and

  • Standard pricing may apply after a promotional period ends if clearly disclosed when purchased.

On The Mat may refuse or cancel promotional purchases obtained through misuse, duplicate accounts, false information, or other attempts to circumvent eligibility requirements.

21. Gift Cards

Gift cards or gift certificates may be subject to separate terms and applicable consumer-protection legislation.

Gift cards:

  • Cannot ordinarily be redeemed for cash;

  • May be used only for eligible On The Mat services or products;

  • May not be replaced if lost or stolen unless we are able to verify the balance and applicable law permits replacement; and

  • Are subject to any restrictions disclosed at purchase.

Any expiry dates or fees will only apply where legally permitted.

22. Prices and Taxes

All prices are displayed in Canadian dollars unless otherwise stated.

Applicable taxes will be added where required by law.

We may change prices prospectively at any time.

Price changes will not ordinarily affect completed purchases, although recurring memberships may be subject to future price changes after appropriate notice and subject to applicable contractual and legal requirements.

If a price is displayed incorrectly because of a clear technical or administrative error, we reserve the right to correct the error before completing the transaction, subject to applicable law.

23. Refunds

Except where required by law or expressly stated otherwise, purchases may be final sale.

Refund eligibility may depend on:

  • The type of service purchased;

  • When cancellation occurs;

  • Whether the service has already been provided;

  • The reason for cancellation; and

  • Applicable consumer-protection legislation.

Refunds approved by On The Mat will generally be returned to the original payment method where reasonably possible.

Processing times are controlled in part by banks, credit-card providers, Momence, and payment processors.

Nothing in our refund policy restricts a refund right provided by applicable law.

24. Transfers

Memberships, packages, credits, promotional offers, and bookings are personal to the purchaser unless On The Mat expressly states otherwise.

You may not sell, transfer, share, or commercially resell your membership or class credits without our written permission.

25. Health and Fitness Acknowledgement

Participation in fitness, yoga, Pilates, strength training, movement, and other physical activities involves physical exertion.

Before participating, you are responsible for considering whether a class or activity is appropriate for your health, physical condition, experience, and abilities.

You agree to inform an instructor of relevant injuries, physical limitations, pregnancy, recent surgery, or other conditions where doing so is reasonably necessary for your safe participation.

You should seek advice from an appropriate qualified healthcare professional if you have concerns regarding your ability to participate.

On The Mat and its instructors do not provide medical advice unless an individual is expressly acting within the scope of an independently held professional healthcare qualification.

26. Assumption of Risk

Physical exercise and movement involve inherent risks.

Depending on the activity, those risks may include:

  • Muscle soreness;

  • Strains;

  • Sprains;

  • Falls;

  • Loss of balance;

  • Collisions;

  • Aggravation of existing conditions;

  • Cardiovascular events;

  • Injury from equipment;

  • Injury resulting from movement or physical exertion; and

  • Other foreseeable or unforeseeable injuries.

By voluntarily participating in On The Mat activities, you acknowledge that physical activity carries inherent risks.

Where a separate assumption-of-risk, release, or waiver document is presented to you, that document forms a separate agreement and may impose additional terms.

27. Liability Waiver

On The Mat may require participants to sign or electronically acknowledge a separate waiver, release of liability, informed-consent document, or assumption-of-risk agreement before participating.

Completion of any required waiver may be a condition of participating in our services.

If you refuse to complete a required waiver, we may decline to permit participation, subject to applicable law.

These Terms are not intended to replace any separate liability waiver.

28. Instructor Direction and Safety

You agree to follow reasonable safety instructions provided by On The Mat staff and instructors.

You are responsible for exercising judgment regarding your physical abilities and may stop participating at any time.

You should not perform an exercise or movement that you believe is unsafe or inappropriate for you.

Instructors may provide modifications, but they cannot guarantee that any movement or modification is appropriate for every participant.

29. Pregnancy

Clients who are pregnant or recently postpartum are responsible for determining, in consultation with their healthcare provider where appropriate, whether participation is suitable.

Please inform your instructor of pregnancy where reasonably necessary to safely participate or obtain appropriate modifications.

30. Illness and Communicable Disease

Please do not attend the studio when you are experiencing a contagious illness or where attending would create an unreasonable health risk to other clients or staff.

On The Mat may establish reasonable health and safety policies in response to communicable-disease concerns, public-health requirements, or other safety considerations.

Clients may be asked to leave if their attendance presents a reasonably identifiable health or safety concern.

31. Studio Conduct

We aim to maintain a welcoming, respectful, inclusive, and safe environment.

You agree not to engage in:

  • Harassment;

  • Discrimination;

  • Bullying;

  • Threatening behaviour;

  • Violence;

  • Sexual harassment;

  • Hate speech;

  • Intimidation;

  • Repeated disruption of classes;

  • Deliberate damage to property;

  • Theft;

  • Unauthorized commercial activity;

  • Unsafe use of equipment;

  • Conduct that places other participants or staff at unreasonable risk; or

  • Behaviour that materially interferes with another person’s enjoyment of the studio.

On The Mat may ask an individual to leave or may suspend or terminate access in response to serious or repeated misconduct.

32. Respectful Environment

We welcome clients of different backgrounds, identities, experience levels, and abilities.

Participants are expected to treat clients, instructors, employees, contractors, guests, and neighbours respectfully.

Aggressive, discriminatory, threatening, or abusive behaviour toward staff or other clients may result in immediate removal from the premises and possible termination of services.

33. Personal Belongings

You are responsible for your personal belongings while attending On The Mat.

Do not bring unnecessary valuables to the studio.

To the extent permitted by law, On The Mat is not responsible for lost, stolen, damaged, or unattended personal property unless the loss results from circumstances for which liability cannot lawfully be excluded.

Please contact us promptly regarding lost property.

Unclaimed items may be donated, disposed of, or otherwise handled after a reasonable period.

34. Studio Equipment

You agree to use studio equipment responsibly and for its intended purpose.

If you are unfamiliar with equipment, ask an instructor for assistance.

You may be responsible for damage caused intentionally or through reckless or unauthorized use, subject to applicable law.

35. Photography and Recording by Clients

To protect the privacy of our community, you may not photograph, film, livestream, or record other clients, instructors, or staff without appropriate permission.

Photography of yourself may be permitted where it:

  • Does not disrupt class;

  • Does not capture others without consent;

  • Does not create a safety issue; and

  • Complies with studio instructions.

Commercial photography, filming, or content production requires prior approval.

36. Photography and Content by On The Mat

From time to time, On The Mat may photograph or record classes, workshops, events, or other studio activities.

Where required, appropriate notice or consent will be obtained before an identifiable individual’s image or likeness is used for promotional purposes.

Additional photography consent forms may apply.

37. Intellectual Property

All intellectual property owned or licensed by On The Mat remains the property of On The Mat or the applicable rights holder.

This includes, without limitation:

  • The On The Mat name;

  • Logos;

  • Branding;

  • Website content;

  • Photography;

  • Videos;

  • Class descriptions;

  • Graphics;

  • Written materials;

  • Marketing content;

  • To access information you are not authorized to access;

  • To scrape or harvest personal information;

  • To impersonate another person;

  • To disrupt the website;

  • To attempt unauthorized account access; or

  • In a manner that could damage On The Mat or its service providers.

We may suspend access where reasonably necessary to protect our systems, users, or business.

39. Website Availability

We aim to keep our website and online services available, but uninterrupted availability is not guaranteed.

The website, Momence, payment systems, or other services may occasionally be unavailable because of:

  • Maintenance;

  • Technical failures;

  • Internet outages;

  • Third-party service outages;

We may modify or discontinue portions of our website or digital services from time to time.

We do not control independent third-party websites or platforms.

Your use of those services may be governed by the third party’s own:

  • Terms;

  • Privacy policy;

The Privacy Policy forms part of the framework governing your use of our services.

Please review it before using our website, creating an account, or submitting personal information.

Any refund following termination will be determined according to applicable membership terms and law.

44. Force Majeure

  • Other result.

Information provided through our website, classes, instructors, social media, or communications is for general fitness and informational purposes and is not intended to replace individualized medical advice.

46. Limitation of Liability

To the maximum extent permitted by applicable law, On The Mat will not be liable for indirect, incidental, special, consequential, or punitive damages arising solely from your use of the website or services.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

Any separate waiver or release executed in connection with physical participation will be interpreted according to its own terms and applicable law.

47. Indemnification

To the extent permitted by law, you agree to be responsible for losses, claims, or expenses resulting from your unlawful conduct, intentional misconduct, or material violation of these Terms.

This provision is not intended to impose liability where doing so would be prohibited by applicable law.

48. No Waiver

If On The Mat does not immediately enforce a provision of these Terms, that does not mean we waive the right to enforce it later.

A waiver will apply only to the particular circumstances for which it was granted.

49. Severability

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be interpreted or limited to the extent necessary to comply with applicable law.

The remaining provisions will continue in effect.
